Class Arbitration Waiver

A contract provision requiring disputes to be arbitrated individually, barring class, collective, or representative arbitration proceedings.

Class arbitration waivers are broadly enforceable in the United States following AT&T Mobility v. Concepcion (2011), which held that the Federal Arbitration Act preempts state-law rules that would invalidate class waivers as unconscionable. Epic Systems Corp. v. Lewis (2018) extended enforceability into the employment context, rejecting arguments that class waivers unlawfully interfere with employees' collective-action rights under the National Labor Relations Act.

The practical effect is significant: class waivers force claimants — often consumers or employees with individually small claims — to arbitrate one at a time, which can make pursuing a low-value claim economically irrational without fee-shifting or an aggregation workaround. In response, plaintiffs' counsel have increasingly used mass arbitration filings, prompting some companies to add batch or staged-filing provisions attempting to limit that strategy.
