Commercial Speech Doctrine

Commercial speech doctrine governs the intermediate level of First Amendment protection given to speech that proposes a commercial transaction, such as advertising, which can be regulated more readily than other protected speech.

Commercial speech receives real but reduced constitutional protection compared to political, artistic, or other fully protected speech. Courts apply an intermediate-scrutiny framework asking whether the speech concerns lawful activity and isn't misleading, whether the government's regulatory interest is substantial, and whether the regulation directly advances that interest without being more extensive than necessary.

False or inherently misleading commercial speech receives no First Amendment protection at all and can be regulated or banned outright, which is part of why false-advertising and consumer-protection statutes coexist comfortably with the First Amendment.
