RCRA Citizen Suit Provision

RCRA's citizen suit provision, Section 7002, lets private parties sue for violations of hazardous waste requirements or to compel abatement of an imminent and substantial endangerment to health or the environment.

Section 7002 authorizes suits against any person, including past and present generators, transporters, and facility operators, alleged to be in violation of a RCRA permit, standard, or order, as well as suits against EPA for failing to perform a non-discretionary duty. As with the Clean Water Act, plaintiffs must serve advance notice — typically 90 days for endangerment claims — before filing, and the suit is barred where the government is already diligently prosecuting a comparable enforcement action.

The endangerment prong does not require proof that harm has actually occurred, only that the handling, storage, treatment, transportation, or disposal of solid or hazardous waste may present an imminent and substantial risk.
