Strict Liability
Liability imposed without proof of fault, chiefly for defective products and abnormally dangerous activities.
Strict liability breaks the usual link between fault and responsibility. A plaintiff does not have to show the defendant was careless, reckless, or intended harm -- only that the defendant engaged in conduct the law treats as inherently risky, or put a defective product into the stream of commerce, and that the conduct caused injury. The doctrine grew out of the idea that some activities and some products carry risks that careful conduct cannot fully eliminate, so the party who created or profited from the risk should bear the loss regardless of how much care it exercised.
Two contexts dominate strict liability litigation: abnormally dangerous activities (blasting, storing explosives, transporting hazardous chemicals) and defective products (manufacturing flaws, design defects, and inadequate warnings). The two branches share a no-fault structure but diverge sharply on elements, defenses, and how courts weigh the underlying policy tradeoffs, so which branch applies changes the whole shape of the case.
The core elements
For abnormally dangerous activities, courts weigh factors drawn from the Restatement (Second) of Torts: the degree of risk and likely severity of harm, whether the risk can be eliminated by reasonable care, whether the activity is uncommon, and whether it fits the location where it occurs. If an activity qualifies, the defendant is liable for resulting harm even if it took every reasonable precaution.
For products, most jurisdictions require the plaintiff to show a product was defective when it left the defendant's control -- through a manufacturing flaw, a design defect, or a failure to warn -- and that the defect caused injury during a reasonably foreseeable use. The defendant's care in manufacturing is irrelevant; the defect itself is the wrong.
Strict is not absolute
A common misconception is that strict liability guarantees recovery. It does not. Most jurisdictions still allow defenses such as product misuse, substantial alteration after sale, assumption of risk, and comparative fault, any of which can reduce or eliminate a strict liability award. States also diverge on the standard for design defects: some retain a consumer-expectations test, while others -- following the Restatement (Third) of Torts: Products Liability -- apply a risk-utility test that looks and feels much closer to a negligence inquiry, asking whether a reasonable alternative design existed.
How it is proven and attacked
Plaintiffs typically build their case with expert testimony establishing the defect, evidence of the product's condition at the time it left the defendant's control, and proof that the defect -- not misuse or later modification -- caused the injury. Alternative-design evidence is central in most design-defect cases. Defendants attack causation, argue the product was altered or misused after sale, invoke the open-and-obvious-danger doctrine, or shift fault onto the plaintiff's own conduct where comparative fault applies.
